I. Definitions

A. “Agreement” means these Terms, together with all policies and documents incorporated by reference, including the Interactive Studio Privacy Policy (available at https://interactive-studio.io/privacy-policy) and any additional terms presented within the apps or on our website(s).
 

B. “Services” means the Interactive Studio applications (currently including multiple Wix Studio apps and any future apps released under the Interactive Studio brand), and all associated software, features, content, updates, and support.
 

C. “Website” means our website(s) and pages operated under the Interactive Studio brand, including [interactive-studio.io], and any Interactive Studio-owned subdomains.
 

D. “User”, “you”, and “your” means any person or entity that installs, accesses, or uses the Services. You must be at least 14 years of age. If you are under 18, you represent that you have obtained the consent of your parent or legal guardian to use the Services and enter into this Agreement.


E. “Interactive Studio”, “we”, and “us” means the operator identified in Section I.G and its employees, contractors, and service providers.


F. “Content” means any content made available through the Services or Website, including text, data, images, designs, software, and documentation. “User Content” means Content created, submitted, or otherwise provided by Users, including website elements, configurations, and materials submitted through the Services.
 

G. Brand / Legal Entity. Interactive Studio is not a separate legal entity. Interactive Studio is a brand owned and operated by EL Industries GmbH, a company registered in Germany. Registered office: Reiserdorf 147, 92721 Störnstein, Germany. All references to Interactive Studio in these Terms refer to EL Industries GmbH operating under the Interactive Studio brand.

II. Relationship with Wix / App Marketplace Terms

A. The Services are provided as Wix Studio apps and may be distributed and billed through Wix. Your use of Wix Studio and any Wix marketplace, billing, or platform features is also subject to Wix’s own terms and policies.
 

B. If there is a conflict between these Terms and mandatory Wix platform requirements applicable to the installation, billing, or technical operation of the app, the Wix requirements apply to that extent.

III. Acceptable Use

A. Compliance with Laws. You must use the Services in compliance with all applicable laws and regulations (including intellectual property, consumer protection, export control, and privacy laws).
 

B. Prohibited Content. You may not upload, post, transmit, or otherwise make available any content that:

  • is unlawful or promotes unlawful activities;

  • is sexually obscene;

  • is defamatory, fraudulent, or deceptive;

  • is abusive or hateful toward any individual or group;

  • contains malware, exploits, or attempts to compromise systems; or

  • infringes any intellectual property or other proprietary rights of any party.
     

C. Prohibited Conduct. You may not:

  • overload, disrupt, or interfere with the Services or Wix systems;

  • attempt to gain unauthorized access to accounts, systems, or networks;

  • impersonate any person or entity, or misrepresent affiliation;

  • violate the privacy or rights of others; or

  • use the Services for unsolicited advertising, spam, or bulk automated activity.
     

D. No Circumvention. You must not attempt to circumvent technical limitations of the Services, including without limitation:

  • removing or bypassing watermarks in the Free plan;

  • manipulating app instances to avoid payment;

  • intentionally overloading the Services (e.g., deliberate API/requests abuse).
     

E. Abuse / Excessive Use. We may throttle, limit, or suspend usage if we determine usage is abusive, excessive, or harmful to the Services, Wix, or other users.

IV. Accounts, Installation, and Access

A. Access to the Services is typically tied to your Wix Studio account and installation of the relevant app(s). You are responsible for maintaining the confidentiality and security of your Wix account credentials.

B. You are responsible for all activity that occurs through your account or app installations.

V. Plans, Fees, Billing, and Taxes

A. Plans. We may offer a Free plan and paid plan(s) (e.g., “Pro”). Plan features may differ. In the Free plan, a watermark may be displayed on the published website. The watermark is removed upon activation of the applicable paid plan, if supported by the app.

B. Billing via Wix. Fees, billing cycles (monthly or yearly), payment processing, invoices/receipts, and cancellation mechanics are handled through Wix’s billing system, as presented to you at checkout and in your Wix dashboard.

C. Automatic Renewal. Subscriptions renew automatically unless cancelled before the end of the current billing period via the Wix app dashboard (or any other method made available by Wix for managing subscriptions).

D. Taxes. Prices displayed through Wix may be exclusive of applicable taxes unless Wix indicates otherwise. You are responsible for any applicable taxes, duties, or levies based on your location and status. If we or Wix are required to collect taxes, you agree to pay them.

E. Price Changes.

  • We may change pricing for plans and Services.

  • For B2C users (consumers): pricing changes apply no earlier than the next renewal period and will be communicated through the Wix billing/checkout flow or comparable notice mechanism made available to you.

  • For B2B users (business customers): pricing changes may apply as permitted by applicable law and Wix billing mechanics.

F. Coupons / Promo Codes. Promotional discounts may be offered via codes or coupons. They may be subject to eligibility requirements, time limits, and additional conditions and may be modified or withdrawn at any time to the extent permitted by law.

VI. Term, Cancellation, and Refunds

A. Term. This Agreement remains in effect while you use the Services and, if you subscribe to a paid plan, for the duration of your subscription.

B. Cancellation. You may cancel your paid subscription effective at the end of the current billing period through the Wix dashboard (or other Wix-provided method). Upon cancellation, you will retain access to paid features until the end of the billing period unless Wix requires otherwise.

 

C. Refunds. As a rule, fees are non-refundable. We may provide refunds, credits, or other remedies at our discretion in individual cases, including in the event of verified technical defects that materially prevent use of the Services. Where consumer law grants mandatory refund rights, those rights remain unaffected.

 

D. Consumer Right of Withdrawal (if applicable). If you are a consumer in the EU/EEA/UK, you may have a statutory right of withdrawal for online purchases. Where you expressly request immediate performance of digital services and acknowledge that you may lose your withdrawal right once performance begins (as implemented through the Wix checkout flow), the withdrawal right may be limited or excluded as permitted by law. Details depend on the checkout information provided.

VII. Support and Communications

A. Support. We provide support via email: support@interactive-studio.io. We generally respond within 72 hours, but response times are not guaranteed.

B. No Phone Support. We do not provide telephone support.

C. Electronic Communications. You consent to receive communications electronically (e.g., via email or within the Services). Such communications satisfy legal requirements for written form where permitted.

D. Legal Notices. Routine communications should be sent to support@interactive-studio.io. For legal notices, you must send notice in writing to the address in Section I.G and additionally by email.

VIII. Updates, Changes, and Availability

A. Updates and Changes. We may modify, update, or discontinue the Services (or parts of them) at any time. This includes changes required by Wix Studio updates or platform constraints.

B. Downtime. The Services may be temporarily unavailable due to maintenance, updates, Wix platform changes, or technical issues. We do not provide a specific uptime guarantee unless explicitly stated otherwise.

IX. Intellectual Property and License

A. Our Rights. We and our licensors retain all rights, title, and interest in and to the Services, including all intellectual property rights. No rights are granted to you except as expressly set out in these Terms.

B. License to You. Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services solely for your own lawful business or personal purposes (including use on your own websites or websites you manage for clients).

C. Restrictions. You may not:

  • copy, modify, translate, or create derivative works of the Services (except as permitted by law);

  • reverse engineer, decompile, or disassemble the Services, except to the extent expressly permitted by mandatory law;

  • remove or obscure proprietary notices; or

  • resell, rent, or sublicense the Services unless expressly permitted by us in writing.

X. User Content; Marketing and Portfolio Use

A. User Content Ownership. You retain ownership of your User Content.

B. License to Operate the Services. You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display User Content solely to the extent necessary to provide and operate the Services.

C. Marketing / Portfolio. Unless you object as described below, you grant us a limited, non-exclusive, royalty-free license to use and display your name, logo, and publicly visible results created using the Services (e.g., website screenshots or examples) for marketing and portfolio purposes.
Opt-out: You may object at any time by sending a written request to support@interactive-studio.io. We will stop using the relevant materials within a reasonable time after receipt.

D. Responsibility for User Content. You represent that you have all rights needed to provide User Content and that it does not violate law or third-party rights.

XI. Suspension and Termination

A. Suspension. We may suspend or limit access to the Services (in whole or part) without liability if we reasonably believe:

  • you have violated these Terms or applicable law;

  • your use poses a security, legal, or operational risk;

  • required by Wix or by law; or

  • your usage is abusive or excessive.

B. Termination for Breach. We may terminate this Agreement immediately if your breach is material or if you fail to cure a breach within a reasonable period after notice (where cure is possible).

C. Effect of Termination. Upon termination, your license ends and you must stop using the Services. Any accrued payment obligations remain.

XII. Disclaimer of Warranties

The Services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including without limitation warranties of merchantability, fitness for a particular purpose, title, security, accuracy, and non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, or compatible with all Wix updates or third-party services.

XIII. Limitation of Liability

A. General. To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or exemplary damages, or for loss of profits, revenue, goodwill, or data, arising out of or related to the Services.

B. Cap (B2B). If you are a business customer, our total liability for any claim arising out of or relating to the Services is limited to the fees paid by you for the Services in the twelve (12) months preceding the event giving rise to the claim.

 

C. Mandatory Liability (B2C and mandatory law). Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for:

  • intent (wilful misconduct) and gross negligence;

  • injury to life, body, or health;

  • liability under mandatory product liability laws; and

  • other mandatory statutory rights applicable to consumers.

D. Business Critical Use. You acknowledge that the Services may be used in business-critical environments (e.g., online shops). You are responsible for implementing appropriate backups, fallbacks, and risk mitigation. We do not assume liability for business interruption or loss arising from downtime, Wix platform changes, or technical issues, except as required by mandatory law.

XIV. Indemnification

If you are a business customer, you agree to indemnify, defend, and hold us harmless from and against claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of your use of the Services, your User Content, or your violation of these Terms or law.

Consumer statutory rights remain unaffected.

XV. Copyright and IP Complaints

If you believe that content associated with the Services infringes your copyright or other IP rights, please contact us at support@interactive-studio.io with sufficient information to investigate the claim. False or frivolous notices may have legal consequences.

XVI. Export Controls and Sanctions

You agree not to use, export, re-export, or transfer the Services in violation of applicable export control laws or sanctions regulations.

XVII. Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide notice (e.g., via Website, email, or in-service notice) at least 30 days before the change takes effect, where required by law. Continued use of the Services after the effective date of changes constitutes acceptance.

XVIII. Governing Law and Jurisdiction

A. Governing Law. These Terms are governed by the laws of Germany, excluding conflict of law rules, except to the extent mandatory consumer protection laws of your country of residence apply.

B. Jurisdiction.

  • If you are a merchant/business customer, the exclusive place of jurisdiction is Weiden i.d.OPf. (Germany).

  • If you are a consumer, statutory jurisdiction rules apply.

XIX. Miscellaneous

A. Severability. If any provision is held invalid, the remainder remains in effect.

B. No Waiver. Failure to enforce a provision is not a waiver.

C. Assignment. You may not assign this Agreement without our prior written consent. We may assign this Agreement as part of a reorganisation or sale of business, subject to applicable law.

D. No Partnership. The Parties are independent contractors.

E. Entire Agreement. These Terms and incorporated policies constitute the entire agreement regarding the Services.
